Medical Marijuana – Patient Information on Eligibility

Qualifying conditions

If you are a current New York State resident and have medical documentation of the diagnosis, of one of the following conditions, you may be eligible for medical marijuana.

  • Chronic pain
  • Cancer
  • PTSD (Post Traumatic Stress Disorder)
  • HIV/AIDS
  • Amyotrophic Lateral Sclerosis (ALS)
  • Parkinson’s Disease
  • Multiple Sclerosis (MS)
  • Spinal Cord Injury with Spasticity
  • Epilepsy
  • Inflammatory Bowel Disease (IBD)
  • Huntington’s Disease
  • Neuropathy / Radiculopathy

The severe debilitating or life threatening condition must also be accompanied by one or more of the following associated or complicating conditions: cachexia or wasting syndrome, severe or chronic pain, severe nausea, seizures, or severe or persistent muscle spasms.

The Medical Documentation Necessary for Eligibility

To ensure eligibility and to begin the patient certification process, we require each patient to have a copy of their medical records to confirm your diagnosis.

The recommended medical documentation should document your relevant condition. For example, if you have Cancer, a recent pathology report from an oncologist is necessary for us to continue the process. For Chronic Pain, a recent EMG, if available. For PTSD, a psychiatrist or psychologist evaluation should be provided, in writing. A list of current prescriptions should also be included .

After review of your medical documentation, our staff will contact you to schedule an appointment within 5 business days.

If documentation is not available, please download the HIPAA Medical Release and Fax Cover Letter. Sign and complete and send directly to your Primary care Provider or Physician’s medical office, who will then be able to send us your medical records on your behalf.

Setting up an Appointment

The office of Dr. Moskowitz requires each patient to have two appointments, which can be done on the same day.

First Appointment for Possible Eligible Patients: The pre-medical marijuana appointment will be a consultation to go over your medical documentation and discuss if medical marijuana is right for you. Please note this is a medical screening visit only, to help determine your eligibility.

Second Appointment for Eligible Patients: This visit is scheduled for the eligible patient who is allowed to participate in the New York medical marijuana program. At this visit, eligible patients will obtain a medical marijuana certification and a medical marijuana recommendation.

What to bring along with you to your appointment: A valid NYS Identification Card, or proof or residence such as a utility bill and a copy of your available medical documentation and/or records

Once you receive your certification from us, you will be able to register online for a medical marijuana card with the Department of Health. This card must be shown when buying medical marijuana at a dispensing facility and carried by the Eligible patient. ​​​

Caregivers

New York State allows Caregivers to obtain a medical marijuana card on behalf of the patients who might be unable to do the process on their own. This includes parents of children under 18. Each Patient and, when necessary, each Caregiver must be available at the initial appointment with the Office of Dr. George Moskowitz.
